What is Medicolegal?

Medicolegal work encompasses a specialized area where the medical and legal professions intersect. It is a critical domain that deals with the application of medical knowledge to legal issues and the legal implications of medical practice. This type of work often involves medical professionals, including physicians, nurses, and other healthcare workers, providing expert opinion on various aspects of law such as personal injury, medical malpractice, workers’ compensation, and forensic examinations.

Expert medicolegal work may include performing independent medical examinations to assess the extent of an individual’s injuries, reviewing medical records for relevance to legal cases, and preparing detailed reports that can be used in court proceedings. The professionals involved must maintain a high level of integrity and neutrality, ensuring that their assessments and opinions are based solely on the evidence presented and their expert knowledge.

To carry out effective medicolegal work, experts must be well-versed in both the relevant areas of medical science and the legal system. They often work closely with legal representatives to clarify complex medical issues that are pertinent to a case. The insights provided by these professionals can be pivotal in the resolution of disputes, influencing the decisions of courts and tribunals.

In essence, medicolegal work requires a balanced approach that respects the established facts, adheres to medical ethics, and satisfies legal processes. Experts in this field play a vital role in ensuring fair outcomes in cases where health and law converge.

Mr. Chatterji’s Experience

“As a specialist Trauma and Orthopaedic Registrar, in London, I started preparing Condition and Prognosis Reports for Personal Injury Cases, in 1997.

In 2012, I prepared my first Breach of Duty report and have been regularly instructed to do so since. The cases have included surgery for total hip replacements, hip resurfacings, knee replacements, anterior cruciate/meniscal injuries and trauma cases.

In 2016 I was the co-author of the generic report in the ASR (DePuy hip resurfacing) group action for the claimants. I was the medical expert for some of the selected test cases.

In the same year I prepared the generic report in the Durom (Zimmer hip resurfacing) group action.

I have been instructed on cases of product liability for hip and knee implants.

I was an invited speaker at the Devon and Exeter Medico Legal Association. I lectured on the regulations and requirements for the introduction of novel orthopaedic implants in the UK.

I chaired the session for the medicolegal aspects of Orthopaedic surgery in a National Orthopaedic meeting.”
